2. Acceptance of Terms
By accessing this Website or contacting us to enquire about or engage our Services, you confirm that you are at least 18 years of age, that you have the legal capacity to enter into a binding agreement, and that you accept these Terms & Conditions in full.
If you are acting on behalf of another person or an estate, you confirm that you have the authority to bind that person or estate to these terms.
3. Description of Services
Pesaka Restu provides inheritance law services in Malaysia, including:
- Understanding an Estate — an initial consultation to explain estate processes and documents (from RM 236)
- Administration & Paperwork Support — assistance with gathering records and preparing documents required for probate or letters of administration (from RM 283)
- Representation with Sensitivity — formal legal representation for inheritance matters before courts or other authorities (from RM 328)
All Services are provided in Malaysia. The scope of each engagement is confirmed in a written engagement letter issued prior to commencement. We do not provide legal advice on matters outside Malaysian law.
4. User Responsibilities
When using our Website or engaging our Services, you agree to:
- Provide accurate, complete, and up-to-date information
- Inform us promptly of any changes to information you have provided
- Not use the Website for any unlawful purpose or in a manner that could damage, disable, or impair it

6. Fees and Payment
Fees for our Services are stated in Malaysian Ringgit (RM). The starting fees displayed on our Website are indicative; the fee applicable to your matter will be confirmed in a written engagement letter before work commences.
Payment is due as specified in the engagement letter. We accept payment by bank transfer and other methods as agreed. We do not proceed with work until fees have been confirmed in writing and, where required, an initial payment received.
In the event that additional work is required beyond the original scope, we will discuss and agree on any additional fees before proceeding.
Cancellation and Refunds
Where a client wishes to discontinue an engagement, we will invoice for work completed to date. Work completed in accordance with the agreed scope is not refundable. We will discuss the position fairly and in good faith in any such circumstances.
7. Confidentiality
We are bound by professional confidentiality obligations as registered advocates and solicitors of the High Court of Malaya. All information shared with us in connection with a legal matter is held in strict confidence and will not be disclosed to third parties except as required by law, with your consent, or as necessary to carry out the services you have engaged us to provide.

10. Termination of Engagement
Either party may terminate an engagement by providing written notice. Upon termination, we will invoice for work completed to the date of notice. We may terminate an engagement immediately if you provide false or misleading information, act in a manner inconsistent with our professional obligations, or fail to pay agreed fees. Clauses relating to confidentiality, intellectual property, and dispute resolution survive termination.
11. Dispute Resolution and Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of Malaysia. Any dispute arising in connection with our Services or this Website shall first be referred to good-faith discussion between the parties. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts of Malaysia.
Professional disputes concerning our conduct as registered solicitors may also be referred to the Malaysian Bar.
12. General Provisions
Entire Agreement. These Terms, together with any written engagement letter issued by us, constitute the entire agreement between the parties in relation to the subject matter hereof.
Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
Waiver. Failure to enforce any provision does not constitute a waiver of the right to enforce it in future.
Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our obligations to a successor practice with notice to you.

13. Changes to These Terms
We may update these Terms from time to time. The revised version will be posted on this page with an updated effective date. Continued use of the Website or engagement of our Services after the effective date constitutes acceptance of the revised terms.
